BuyerBids Terms of Service

These Terms of Service ("Terms") are a binding agreement between you ("Contractor," "you") and BuyerBids, operated by Buyer Network LLC ("BuyerBids," "we," "us," or "our"), governing your use of the BuyerBids marketplace at buyerbids.io, its dashboard, and related services (the "Platform"). By creating an account, funding a wallet, bidding, or otherwise using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.

1. What BuyerBids is

BuyerBids is an online marketplace where home-improvement Contractors browse, bid on, and purchase confirmed, verified in-home appointments with Homeowners across four categories: roofing, windows & doors, kitchen, and bathroom. Each listing includes the property address, a property photo, the full scope of work, and a recorded Homeowner confirmation call.

BuyerBids provides the marketplace and the appointment. BuyerBids is not a party to, and does not guarantee the outcome of, any sale, contract, or work you may later perform for a Homeowner. We do not guarantee that any Homeowner will purchase your services, sign a contract, or proceed with a project. You are an independent business responsible for your own sales, licensing, insurance, work, and conduct.

2. Eligibility and accounts

You must be at least 18 years old, be a legitimate home-improvement business or an authorized representative of one, and hold all licenses, registrations, and insurance required to perform the relevant work in the applicable jurisdiction. You agree to provide accurate registration information, keep it current, keep your credentials confidential, and are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or abusive.

3. Appointment verification (what "confirmed & verified" means)

Before a listing goes live, our team confirms the appointment with the Homeowner and records the confirmation call. "Confirmed & verified" means we have taken reasonable steps to schedule and confirm a real in-home appointment with a Homeowner who has expressed interest in the described project. It does not mean the Homeowner is guaranteed to buy, has financing, or will ultimately proceed. You are responsible for evaluating each listing — including the recording and scope — before you bid or buy.

4. Wallet, pricing, and payments

Wallet. You fund a prepaid wallet to participate. Wallet funds are used to pay for appointments you win or buy. Browsing is free. Funds are only deducted when you win a bid or complete a Buy-It-Now purchase. Placing a bid does not deduct funds at the time of the bid, but you must maintain a wallet balance sufficient to cover your bids.

Pricing tiers. Pricing is set by how many decision-makers were confirmed present on the Homeowner call, not by job type:

$395 starting bid — appointments where one decision-maker is confirmed present.
$495 starting bid (Premium) — appointments where both decision-makers (e.g., homeowner and spouse) are confirmed present on the call.
$595 Buy It Now — available on any appointment to skip the auction and secure it instantly.

Prices are in U.S. dollars. We may change pricing and tiers prospectively; the price shown on a listing at the time you bid or buy is the price that applies to that listing.

Payment processing. Wallet funding and payments are handled by a third-party payment processor. You authorize us and our processor to charge your selected payment method for the amounts you initiate. Wallet balances do not earn interest and are not deposit accounts.

5. Bidding and Buy-It-Now

Bids are binding. When you place a bid you make a binding commitment to purchase the appointment at your bid amount if you are the winning bidder when the auction closes. Your bid must be at least the listing's current minimum (the starting bid if there are no bids yet, otherwise above the current high bid) and below the $595 Buy-It-Now price.

Winning. When an auction closes, the highest valid bid wins, and the winning bid amount is deducted from that Contractor's wallet. Buy It Now immediately secures the appointment at $595 and ends the auction.

Contact unlock. When you win or buy an appointment, the Homeowner's full contact and appointment details are unlocked in your My Appointments. You may use this information only to attend and service that specific appointment.

All sales are final except as expressly provided in the No-Show Credit-Back Policy below.

6. No-Show Credit-Back Policy

We stand behind the appointments we verify. If a Homeowner is a genuine no-show, you may request an account credit under the following terms. This is the complete policy; please read it carefully.

6.1 Eligibility. Credit-backs are issued only for verified Homeowner no-shows supported by valid proof. A "no-show" means the Homeowner failed to be present for the confirmed appointment at the scheduled address, date, and time.

6.2 When you may request. The "Request Credit Back" option becomes available only after the scheduled appointment time has passed for an appointment you own. Requests cannot be submitted before the appointment time.

6.3 Required proof. You must submit timestamped proof — a photo or video that demonstrates you were at the correct address at the correct appointment date and time. Proof lacking a verifiable timestamp, or that does not establish your presence at the correct location and time, will be rejected.

6.4 Required attestations. When submitting a request, you must attest that (a) you did not contact the Homeowner to reconfirm or reschedule the appointment before the appointment day and time, and (b) you arrived on time for the appointment. Submitting a false attestation is a violation of these Terms.

6.5 Review. After you submit, our team reviews the request and performs due diligence over 2 to 5 business days. Verification is at BuyerBids's reasonable discretion based on the proof and records.

6.6 Outcome. If we verify the no-show, we issue you a credit of one (1) appointment free of charge. The credit is applied to your account and automatically applies to your next appointment purchase (your next Buy-It-Now or won bid), reducing that charge to $0. Credits have no cash value, are non-transferable, and may not be redeemed, exchanged, or withdrawn for money.

6.7 Exclusions — when credits are NOT issued. We will not issue a credit-back if any of the following applies:

you contacted the Homeowner to reconfirm or reschedule the appointment before the appointment day and time;
you did not arrive on time for the appointment;
you do not submit valid timestamped photo or video proof of your presence at the correct address and time;
the appointment occurred, the Homeowner was present, or the Homeowner declined your services (a no-sale is not a no-show);
the proof or attestations are inaccurate, altered, or fraudulent; or
the request otherwise does not meet the requirements of this Policy.

6.8 Abuse. Abuse of the credit-back program — including fabricated proof, false attestations, or repeated bad-faith requests — may result in denial, forfeiture of credits, and suspension or termination of your account.

7. Contractor obligations and use of Homeowner information

You agree to:

act professionally and attend won appointments on time and prepared;
use Homeowner contact and appointment information solely to service the appointment you won or bought, and not for any other marketing, resale, or purpose;
not contact the Homeowner to reconfirm or reschedule before the appointment (doing so voids any no-show credit eligibility for that appointment);
comply with all applicable laws in your outreach and work, including consumer-protection, Do-Not-Call, TCPA, telemarketing, licensing, and privacy laws;
not share, sell, resell, republish, or transfer appointment data, Homeowner information, or call recordings to any third party;
not misrepresent your identity, licensing, or affiliation to Homeowners.

8. Prohibited conduct

You may not: use the Platform for any unlawful purpose; interfere with or attempt to circumvent auction, wallet, or security mechanisms; use bots, scrapers, or automated means to access listings or place bids; manipulate bidding; upload malicious code; attempt to access accounts or data that are not yours; or use the Platform in a way that harms Homeowners, other Contractors, or BuyerBids.

9. Cancellation and wallet balances

There is no subscription; you pay only for appointments you win or buy. You may stop using the Platform at any time. Remaining wallet balances that were funded but not spent may be refundable in accordance with our then-current wallet refund practices and applicable law; amounts already spent on won or purchased appointments, and issued credits, are non-refundable except as required by law or expressly stated in the No-Show Credit-Back Policy. 10. Disclaimers

THE PLATFORM AND ALL APPOINTMENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYERBIDS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY HOMEOWNER WILL PURCHASE YOUR SERVICES, THAT ANY APPOINTMENT WILL RESULT IN A SALE, OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR SUCCESS DEPENDS ON YOUR OWN SALES, PRICING, AND WORK.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUYERBIDS AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BUYERBIDS FOR THE APPOINTMENT GIVING RISE TO THE CLAIM, OR (B) [INSERT CAP, e.g., $500]. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless BuyerBids and its owners, officers, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, your interactions with or work for Homeowners, your use of Homeowner information, or your violation of these Terms or applicable law.

You acknowledge that Homeowner confirmation calls are recorded and made available on the Platform for verification purposes. All BuyerBids content, branding, software, and listings compilations are owned by BuyerBids or its licensors and are protected by law; you receive a limited, revocable, non-transferable license to use the Platform for its intended purpose. You may not copy, resell, or create derivative works from Platform content except as expressly permitted.

14. Suspension and termination

We may suspend or terminate your access at any time for violation of these Terms, suspected fraud, or risk to the Platform or its users. Upon termination, your right to use the Platform ends; provisions that by their nature should survive (including payment obligations, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Governing law and disputes

These Terms are governed by the laws of [State/Country], without regard to conflict-of-laws rules. 16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, provide additional notice. Your continued use of the Platform after an update means you accept the revised Terms.
